Who this is between
This release is between you, the person sending the photo, and DSG Mining, the gem mining attraction at Orlando International Premium Outlets, 4951 International Dr, Orlando, Florida 32819 ("DSG Mining," "we," "us"). It covers the photo you send through dsgmining.com/share and any caption or hometown you add to it (together, "your submission").
What you confirm
You confirm that you are at least 18 years old, that you took the photo or have the right to share it, and that you are the parent or legal guardian of every minor who appears in it or have the permission of that minor's parent or legal guardian. If other adults appear in the photo, you confirm they agreed to its use under this release.
What you allow us to do
You give DSG Mining a non-exclusive, royalty-free, worldwide permission to use, copy, display, crop and lightly edit your submission, including the names and likenesses of the people shown in it, in these places: our website, our social media accounts, screens and signs at our kiosk, and our marketing and advertising in any medium. We may share your submission with Deep Sea Gypsy, the store our kiosk sits in front of, for the same uses.
You will not be paid for this use. You agree that we do not need to show you a post or ad before it runs.
This release is your express written consent to that use, including for the purposes of section 540.08 of the Florida Statutes.
What we promise
- We review every photo before it is posted, and we may decline any photo for any reason.
- We do not post children's full names, and we never post your email address.
- We remove location data from your photo when it is uploaded.
- We do not sell your submission or your contact details.
Taking a photo down
You can ask us at any time to stop using your submission by emailing photos@dsgmining.com from the address you used to send it. We will remove it from our website and kiosk screens and stop using it in new posts or ads within 10 business days. We cannot pull back copies already printed or posts other people have shared, saved or reposted.
Release of claims
To the extent the law allows, you release DSG Mining, its owners and its staff from claims related to the uses allowed by this release, including claims for invasion of privacy, right of publicity or misappropriation of likeness. This does not cover any use that breaks the promises above.
General
Florida law governs this release. If any part of it cannot be enforced, the rest still applies. We keep a record of each release, including the date and time it was accepted and the version accepted. If we change this release, the new version applies only to photos sent after the change.
